With oil and gas industries being the largest private land owner in Garfield County under &quot;private right to use without public review&quot;, the industry has opportunity to make their &quot;split estate&quot; interests whole without public review or impact assessment. 

The Commissioners are trying to remove all 1041 powers from the Land Use Codes redlining all water, soil, wildlife, public health, safety, and environmental protections. As Phil Vaughn stated, &quot;This is the heart of the plan.&quot; In other words, water, wildlife, historic significance, public health, and safety are considered barriers to economic develop of &quot;the industry&quot; with saying, &quot;the industry&quot;.

These changes will ultimately punt local control for permits to broad state and federal regulators. While commissioners are standing on the strength of state and federal regulation, they fail to mention that oil and gas are exempt from the Clean Water and Clean Air Acts at the national level. The Preamble of the 1876 Colorado Constitution states:

&quot;We, the people of Colorado, with profound reverence for the Supreme Ruler of the Universe, in order to form a more independent and perfect government; establish justice; insure tranquility; provide for the common defense; promote the general welfare and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this constitution for the &#039;State of Colorado&#039;&quot;. And;

Article II, Sec. 1 of the Colorado Constitution under Bill of Rights “VESTMENT OF LEGAL POWERS”.

&quot;In order to assert our rights, acknowledge our duties, and proclaim the principles upon which our government is founded, we declare:  All political power is vested in and derived from the people; all government, of right, originates from the people, is founded upon their will only, and is instituted solely for the good of the whole.&quot; And:

In a 1938 Colorado “well settled” case law:  &quot;All governmental departments must answer to the people. It is well that all departments give pause, that they may not offend. All must answer to the people, in and from whom, as specifically set forth in this section, all political power is invested and derived. Hudson v. Annear, 101 Colo. 551, 75 P.2d 587 (1938).&quot;

Therefore, based upon the above and the unthinkable political and legal powers granted to the COGCC by an act of the legislature, and not by the consent of “We the people of Colorado”, the unconstitutionality of the COLORADO OIL &amp; GAS CONSERVATION COMMISSION is quite apparent.  In federal district court, use MARBURY V. MADISON as the controlling precedent and SPEER as Colorado case law precedent.
